On March 9, 2018, Peter Goodman served as the moderator of a panel discussion on developments in wage and hour law, including arbitration and settlement issues under the Fair Labor Standards Act. The panel was part of the day-long Employment Law Institute presented by the Labor and Employment Committee of the New York City Bar Association. Topics also included minimum wage increases, the New York City Fair Workweek Law, and the New York City Freelance Isn’t Free Act. Among other things, the panel discussed the recent Second Circuit decision in Rodriguez-Depena v. Parts Authority, Inc., which held that claims under the FLSA for overtime pay are arbitrable. The panel also addressed Yu v. Hasaki Restaurant, Inc., now pending before the Second Circuit, which presents the issue of whether litigants may resolve FLSA claims pursuant to Federal Rule of Civil Procedure 68, without the need for judicial or Department of Labor approval.
